Rules for Using the NetArt sp. z o.o. Internet Service
  1. General provisions.
    1. Rules shall mean the Rules for Using the NetArt sp. z o.o. Internet Service.
    2. The service provider is NetArt Sp. z o.o. with registered office at Cystersow 20a, 31-553 Krakow, entered in the register of businesses of the National Court Register with the District Court for Krakow Srodmiescie, XI Commercial Division of the National Court Register, under the number 0000309891, National Business Registry Number (REGON) 120731417, with a share capital of PLN 50,000 – hereinafter referred to as "NetArt".
    3. These Rules specify the terms and conditions as well as the extent of permissible use of the internet website at the following address: www.netart-registrar.com, hereinafter referred to as "NetArt's Website".
    4. Client, as used in these Rules, shall mean an entity using NetArt's Website.
    5. Consumer shall mean a natural person using NetArt's Website for purposes which are not directly related to its business or trade.
    6. Users who use the www.netart-registrar.com website shall be bound by the provisions of these Rules.
    7. These Rules are the rules referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services.
    8. The www.netart-registrar.com website is administered by NetArt.
    9. The content of NetArt's websites is the property of NetArt and is legally protected.
    10. Unless otherwise specified, users of NetArt's Website shall be entitled to browse NetArt's Website and save it in any form solely for personal use.
  2. Technical requirements and conditions necessary to work with NetArt's teleinformation system.
    1. In order to open and use NetArt's Website, a computer connected to the Internet is required, which operates Mozilla Firefox 3.6 browser or equivalent.
    2. NetArt reserves the possibility that cookies, or other files having the same functionality, will be left in Client's computer system.
  3. Obligation to comply with the law.
    1. Client agrees to use the service in a manner that shall not breach third-party rights (personal rights, copyrights), good practices, or provisions of the law, and shall be liable for the manner of using the service by third parties to whom Client makes the service available.
    2. Public copying and distribution of the content of NetArt's Website without its consent requires that applicable provisions of the Polish law are observed, in particular the provisions of the Act of February 4, 1994 on copyright and related rights (i.e. Dz. U. [Journal of Laws] 2000, No. 80, item 904, as amended).
    3. Trade names, product names or other marks (including graphic) published on NetArt's websites, which are trademarks, are subject to legal protection, in particular on the basis of the provisions of the Act of June 30, 2000 – Industrial property law (i.e. Dz. U. [Journal of Laws] 2003, No. 119, item 1117, as amended). Any use thereof may only take place upon prior written approval of authorized persons.
    4. Saving materials from NetArt's websites by users shall be at their own risk and liability. In the event any damage occurs in the user's computer systems or any data is lost as a result of saving such materials, Client shall not be entitled to pursue any claims against NetArt.
    5. The content of NetArt's websites has been developed by NetArt in good faith and on the basis of sources considered to be reliable, however NetArt shall not be liable for any damage resulting from the use of the content of its websites.

    7. It shall be prohibited to use NetArt's websites in a way which is against the law, principles of social intercourse, good practices, and netiquette. This includes, but is not limited to:
      1. mass sending of packages to NetArt's websites,
      2. mass downloading of the contents of NetArt's websites, in full or in part,
      3. all other actions which reduce the performance of NetArt's websites.
    8. The actions described in III.7 may constitute a reason for NetArt to immediately block access to NetArt's websites for a given user and report the case to law enforcement organs for examination, as well as take actions provided for in the Civil Code.
  4. Complaint procedure.
    1. Client's compliant regarding a failure to perform or inadequate performance of the services shall be sent to NetArt in writing to its correspondence address, and specify the following:
      1. Client data to enable contact and its identification as NetArt's Client,
      2. type of service subject to complaint,
      3. time and place of the occurrence subject to complaint,
      4. Client's claims,
      5. circumstances to substantiate the complaint,
      6. requested way of curing the claimed breach, if any.
    2. NetArt shall be obliged to respond to the complaint in writing within 7 days of its receipt, indicating whether it accepts the complaint and how it intends to handle it, or informing about insufficient grounds to accept the complaint and substantiating its position. In the event it is necessary to clarify further circumstances connected with the services provided to NetArt by entities for which NetArt bears no liability, NetArt shall send a relevant notification within 7 days.
  5. Final provisions.
    1. Any disputes arising out of the agreement between Client and NetArt which they were unable to prevent by adhering to the complaint procedure shall be settled by a common court of competent jurisdiction of NetArt's registered office. However, in case of disputes with Clients who are consumers, the competent court shall be a court of competent jurisdiction of the defendant's place of residence (registered office).
    2. These Rules shall be in force from November 15, 2010.
